Terms of Service

These Terms of Service (“Terms”) govern your use of the Dictate book writing service (“Service”) provided by Appendment LLC d/b/a Dictate (“Company,” “we,” “us,” or “our”), located at 123 E Tarpon Avenue #305, Tarpon Springs, FL 34689. By purchasing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Service Description

Dictate is an AI-powered book writing service that transforms your expertise into a professionally written book through guided AI interviews. Our service includes:

• Pre-interview research and preparation using publicly available information about you and your expertise.
• AI-conducted phone interviews to extract your knowledge, stories, and frameworks.
• Voice DNA analysis to capture your unique writing voice and communication style.
• Book planning, outlining, and chapter organization.
• AI-assisted writing of your manuscript based on your interview content.
• Revision and editing based on your feedback.
• Delivery of the completed manuscript via Google Docs.

Account & Payment

Payment Terms

• All payments are processed securely through Stripe.
• Payment is required in full at the time of purchase.
• Prices are listed in US dollars and are subject to change for future purchases. Your package price is locked at the time of purchase.

Refund Policy

• Before discovery call: Full refund available within 14 days of purchase if no discovery call has been conducted.
• After discovery call, before writing: Partial refund (minus the cost of completed interviews and research) available if you decide not to proceed.
• Once writing has begun: No refunds are available after chapter drafting has commenced, as significant AI processing and creative work has been invested.

Intellectual Property

Your book is your intellectual property. Here is exactly how ownership works:

• You own 100% of the copyright to the completed book manuscript. Dictate retains no rights to your book content.
• All content in your book originates from your interviews, materials, and expertise. The AI organizes and writes based on your input — it does not generate content from external sources.
• Dictate does not claim any royalties, licensing fees, or ongoing payments related to your book.
• You are free to publish, distribute, sell, or license your book in any way you choose.
• Dictate retains the right to mention that we assisted in the creation of your book (e.g., in case studies or marketing), unless you opt out in writing.

Service Process

The Dictate service follows a structured process:

1. Onboarding: You provide your background information, goals, and any existing materials.
2. Discovery call: An AI-conducted interview to understand your expertise and book vision.
3. Research & planning: We research your background and generate a book outline with chapter structure.
4. Deep interviews: Multiple AI-conducted calls to extract stories, frameworks, and knowledge for each chapter.
5. Writing: AI-assisted drafting of each chapter using your Voice DNA profile for authentic voice matching.
6. Review & revision: You review chapters in Google Docs and provide feedback. We revise based on your comments.
7. Delivery: The completed manuscript is delivered to you in Google Docs format.

Your Responsibilities

• Participate in scheduled interviews in good faith.
• Provide accurate information during interviews and in uploaded materials.
• Review chapter drafts and provide feedback within a reasonable timeframe (typically 7 business days).
• Ensure you have the right to share any materials you upload.

Limitation of Liability

To the maximum extent permitted by applicable law:

• Dictate is not responsible for the commercial success or failure of your book after delivery.
• Our total liability for any claims arising from the Service shall not exceed the amount you paid for your package.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.
• We do not guarantee specific word counts, publishing outcomes, or sales results.
• We make reasonable efforts to ensure data security but cannot guarantee absolute security against all threats.

Termination

Either party may terminate the Service under the following conditions:

• By you: You may cancel the Service at any time by contacting us at legal@startdictate.com. Refund eligibility is subject to the Refund Policy above.
• By us: We reserve the right to terminate the Service if you breach these Terms, provide false information, or engage in abusive conduct toward our systems or team.
• Upon termination, you retain ownership of all completed book content. In-progress drafts will be delivered in their current state.
• Interview recordings and personal data will be handled according to our Privacy Policy.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Pinellas County, Florida.

SMS Terms

If you opt in to receive SMS notifications from Dictate by Appendment LLC:

• Consent: By checking the SMS consent box during onboarding, you consent to receive text messages about your book project, including scheduling reminders, interview confirmations, and status updates.
• Frequency: Message frequency varies based on your project activity, typically 2–5 messages per week during active phases.
• Opt-Out: Reply STOP to any message to unsubscribe. You will receive a confirmation message. Opting out of SMS does not affect your project or service.
• Help: Reply HELP to any message for assistance, or email hello@startdictate.com.
• Costs: Message and data rates may apply depending on your carrier plan. Dictate does not charge for SMS messages.
• Carrier Liability: Carriers are not liable for delayed or undelivered messages.
• Age Requirement: You must be 18 years of age or older to use this SMS service.
• Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Material changes will be communicated via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
